1. Acceptance of Terms
By accessing or using Just In Case ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.
2. Description of Service
Just In Case is a dead man's switch messaging platform that allows users to configure automated emergency notifications to designated contacts if the user fails to check in within a defined time window. The Service is intended exclusively for legitimate personal safety, emergency preparedness, and welfare-check purposes.
3. Acceptable Use Policy
You may only use the Service for lawful purposes consistent with its intended function as a personal safety tool. The following uses are strictly prohibited:

| Fraud | Using the Service to facilitate fraud, extortion, blackmail, or any criminal activity |
| Abuse of Recipients | Sending messages to contacts who have not consented to receive emergency notifications from you |
| System Abuse | Attempting to circumvent, hack, reverse-engineer, or overload the Service's infrastructure |
| Malicious Content | Uploading or transmitting malware, viruses, or any harmful code via attachments or messages |
Violation of this Acceptable Use Policy may result in immediate account suspension or termination without notice. We reserve the right to report unlawful activity to appropriate authorities.
4. Dead Man's Switch Disclaimers
By activating a switch, you authorize Just In Case to automatically send your pre-configured messages to your designated contacts if you fail to check in by your deadline. You understand and agree to the following:
- We make no guarantee that messages will be delivered at the exact time the switch triggers. Email and SMS delivery depend on third-party services outside our control.
- Messages may fail to deliver due to spam filters, incorrect contact information, carrier restrictions, or service outages.
- Check-in reminders may be delayed or not delivered due to technical issues.
- System failures, maintenance, or outages may prevent proper execution of switch triggers.
- You are solely responsible for ensuring all contact information is accurate and up to date.
- We strongly recommend sending a test message before relying on the Service in any critical situation.
- The Service is a supplementary safety tool and should not replace direct communication with emergency services (911, local police, etc.).
5. User Responsibilities
You are solely responsible for all activity under your account, including the content of messages you configure, the accuracy of contact information you provide, and ensuring that your designated contacts have consented to receive emergency notifications from you. You must comply with all applicable laws and regulations, including those governing electronic communications and messaging in your jurisdiction.
6. Limitation of Liability
To the maximum extent permitted by applicable law:
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Just In Case, its operators, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of or inability to use the Service, including but not limited to: failure to deliver emergency messages, loss of data, service interruptions, or any harm resulting from reliance on the Service as a sole emergency communication method.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount you paid us in the twelve (12) months prior to the event giving rise to the claim.
7. Indemnification
You agree to indemnify, defend, and hold harmless Just In Case and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, your violation of any third-party rights, or any content you transmit through the Service.
8. Service Availability
We do not guarantee uninterrupted, error-free, or continuously available service. We reserve the right to suspend, modify, or discontinue the Service or any feature at any time with or without notice. We will make reasonable efforts to provide advance notice of planned maintenance or significant changes.
9. Account Termination
We may suspend or terminate your account at our discretion, including for violation of these Terms, illegal activity, or abuse of the Service. Upon termination, your access to the Service will cease and your data may be deleted in accordance with our data retention practices.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described therein.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall first be subject to good-faith negotiation between the parties. If negotiation fails, disputes shall be resolved through binding arbitration. You waive the right to participate in class action lawsuits to the extent permitted by law.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
